How is Collaborative Divorce Mediation
different from traditional litigation?

In traditional litigation, your case is handed over to attorneys, and decision
making is turned over to a judge that do not know you or your family. The result is, you have very little control
over the process and will have to live with the decisions they give you. Often, your case can take years
to complete and is very costly financially and emotionally to your family. In comparison, the Collaborative Divorce Mediation Team approach is faster, more efficient, less
costly, and you have control over the decisions that will effect you and your family for years to come. This is a no
court divorce approach, that doesn't require court appearances. You will have a team of professionals committed to resolving
disputes respectfully, working together in a non-adversarial way, to support you through the process. We use a Collaborative
Attorney who serves as a Collaborative Mediator. We use Collaborative Divorce Coaches for husband and wife, a Neutral
Financial Professional and a Child Specialist when needed.

How does this process work?

Collaborative Divorce Mediation
is a new way of handling all aspects of family law issues, including custody, visitation, support issues, co-parenting plans and
division of assets and debts. It is a method whereby the parties use our Collaborative Divorce Mediation team which consists
of the following professionals: Brian Don Levy
– Collaborative Attorney & Collaborative
Mediator, Beverly Jewell – Divorce Coach and Case Manager, Marvin Chapman –
Divorce Coach, Tracy McKenney – Neutral Financial
Professional. We are a cohesive team
of collaborative professionals, highly experienced and committed to the collaborative process. We have enjoyed working
together on many collaborative cases and mediations. Our history of success enables us to offer clients an efficient
business model, built on trust in each other and the process, that leads to family centered solutions. We are all members
of IACP and have a deep understanding of how to lead clients through the door of success and reach the other
side. In employing the Collaborative Divorce Mediation process,
you agree to opt out of the judicial system and work in the Collaborative Divorce Mediation process with your team of collaborative
professionals. Your team will assist you in resolving disputes respectfully using cooperation and problem-solving, which
is a non-adversarial, no court divorce approach. With the help of the team, negotiations between the parties are interest-based
rather than positional. In other words, each party's interests, as well as the needs of the children, is considered
when crafting a resolution, looking at "middle ground" or third options. When the Collaborative Divorce Mediation process is successfully completed, the parties may consult with a
separate collaborative attorney to review any documents prior to signing them. Negotiations are handled on an informal level, with each party attending a series of structured meetings in which both spouses meet with the Collaborative Divorce Mediation
team and discuss the resolution of the divorce. One major difference between the Collaborative Divorce Mediation process and
other approaches is that the clients themselves craft the terms of their divorce and the final outcome rather than having
an outside third party decide the outcome for them.
How much will this cost and how long will it take?

All team members work from a retainer and the fees of each
person will depend on the service they provide and their years of experience. We are committed to working
in an efficient, non-adversarial way, so the overall cost will be much less than if your case was being handled by two
attorneys through the court system.
The length and cost of a case depends on many factors, but
when you're able to work in a collaborative manner with your spouse, it keeps the fees at a minimum, and helps your
case be completed more quickly, with less costs.
